The nonprofit choir entered into agreement to perform in Christmas show with the singer at Beacon Theater, New York. Nov. 28th 2016, two days before scheduled rehearsals, the singer’s management called off the choir, citing Carey has other arrangements to use another group. Michael Morobitto, Carey's production manager, could not provide a concrete reason for cancelling. The choir’s lawyer had written to Carey’s management with strong words that they choir is not pleased with the action. He encouraged Carey’s team to execute the contract in its entirety, including crediting them with negotiated fees irrespective if they don’t want his client to perform.

Members of the group claims, they are mostly professionals. They had made provision for the show months ahead by calling off other engagements. More so, they  informed the court that proceeds from appearing in the show would have benefited non privileged children and charity organizations they patronize. They argued that the show turned out to be a huge sell thereby making them to loose out from the proceeds.
